Support Three States that are Working to Amend
Their Constitutions to Protect the Right to Refuse!
A constitutional amendment can be the strongest way to make change
happen as it represents the bedrock law of a state.
There are many ways to shape the legal landscape of a community. Two of the main methods are to: 1) change statutes by legislation, and 2) amend the state constitution.
The most common way to amend a state constitution is by having the legislature pass a proposed constitutional amendment, which then goes to the voters for ratification or approval. It is harder to change a constitution than a statute, but also harder to undo such changes. This is a powerful tool for advocates and the public.
Around the nation, three states have introduced a total of seven different proposed constitutional amendments to protect the Right to Refuse. If you live in one of these states, support their efforts!
Louisiana
In Louisiana, four bills seeking to initiate constitutional amendments are now being considered:
SB1: This proposed constitutional amendment adds “immunization status” to age, sex, or physical condition, as a protected class regarding discrimination for access to public areas, accommodations, and facilities.
HB53: Ensures the people of the state of Louisiana that they shall have the fundamental right to autonomy with respect to making decisions regarding their health care. This right shall include but not be limited to the right to accept or reject any form of health care including palliative care, medical treatment, surgical procedure, vaccine, or any form of medicine, and requires that any restriction of this right shall be subject to strict scrutiny.
HB177: The current constitution prohibits discrimination based on various categories, including physical condition. This proposal provides that physical condition includes vaccination status or immunity status.
HB596: Ensures that each individual shall have the right to bodily autonomy, to make their own healthcare decisions, and to be free to accept or refuse any health service, including vaccines, based on religious, philosophical, or personal beliefs.to supp

Missouri
In Missouri, two proposed constitutional amendments are pending:
SJR47: Prohibits the passage or implementation of any law or public policy by the state, its subdivisions, or schools receiving public funds, that infringes upon the unquestionable right of individuals to refuse any medical procedure or treatment, including, but not limited to, injections, vaccines, or prophylactics.
SJR50: Prohibits the passage or implementation of any law or public policy by the state or its subdivisions, that infringes upon the unquestionable right of individuals to refuse any medical treatment or procedure, including injections, vaccines, or prophylactics. Equality under law shall not be denied due to the exercise of this right.

Pennsylvania
Pennsylvania is considering HB2013. This bill would add to the state constitution that the right of an individual to refuse any medical procedure, treatment, injection, vaccine, or prophylactic may not be questioned or interfered with in any manner. Equality of rights under the law shall not be denied or abridged to any person in this Commonwealth because of the exercise of the right under the proposal. According to Health Freedom Pennsylvania, as of March 30 there were 40 co-sponsors for HB2013, and the bill is gaining momentum from grassroots groups and citizens from all over the state.
